Navigate CMA compliance, funding rules, and the 21-year data retention rule with our solicitor-approved guide.
Contracts are legally required for every registered childminder. The EYFS Statutory Framework (Section 3.2) mandates a written agreement with every parent before care begins. Without a signed contract, you have no legal recourse if a parent disputes charges, refuses to pay a notice period, or pulls a child without warning. A signed contract is what turns a verbal arrangement into an enforceable agreement.
Ofsted requires your written agreements to cover fees, schedules, notice periods, safeguarding responsibilities, and GDPR data handling. Inspectors ask to see a signed contract at every routine inspection. Settings that present a clear, comprehensive contract at inspection demonstrate professional credibility. Settings that cannot produce one raise immediate concerns.
KinderStart generates your contract from the details you enter during setup — rates, schedule, funding allocation, and payment terms. Every contract includes Ofsted-required clauses as standard. Add your own clauses using the Contract Template Editor for specific arrangements such as term-time care, sibling discounts, or flexible shift-worker schedules.

CONTRACTS: The digital child profile and contract hub
The CMA requires contracts to be fair and transparent. A contract containing unfair terms — such as non-refundable deposits that do not reflect actual loss — may be legally unenforceable.
Jan 2026 Mandate. Charging a "top-up fee" for core funded hours is illegal. Separate Care (£0.00 for funded hours) from Voluntary Consumables (meals, outings). Give parents the option to opt out and provide their own supplies.
The Statutory Framework (EYFS 2024/25) requires your policies to be active documents, not dusty binders.
The Limitation Act 1980 creates a unique challenge.
Digital Resilience. Storing paper logs for 21 years risks ink fading and binders being lost. KinderStart's Evidence Vault archives your signed contracts and safety logs in an encrypted, non-editable format for their full legal lifespan.
Every template must be reviewed against your Local Authority's requirements before you use it with families. LA funding rules vary. A template that meets one LA's requirements may miss another's.
Follow these steps before generating any contract:
Check every September. Your LA updates its funding guidance at the start of each academic year. Review your templates each September and regenerate contracts for any families where terms have changed.
Zero Disputes. Both you and the parent access the same current terms through the shared digital contract. This eliminates "I don't remember signing that" disputes that plague paper-based settings.
KinderStart generates your policies from the answers you give during setup. Every policy references the current regulatory framework — EYFS 2024/25, the Safeguarding and Welfare Requirements, the Health and Safety at Work Act 1974, Data Protection Act 2018, and the Children Act 1989 and 2004.
When legislation changes, KinderStart updates the policy templates and notifies you. Open the Policy Documents section in the Tools Hub, review the updated clauses, and republish to the parent portal.
Your policies cover these statutory requirements:
Add setting-specific detail before publishing each policy. KinderStart provides the framework. You provide the specifics of your practice.
